DMCA / Copyright Policy (Oath)

Oath (“Oath,” “we,” “us,” “our”) respects intellectual property rights and expects users to do the same. This DMCA / Copyright Policy (“Policy”) explains how to submit copyright infringement notices and how we handle repeat infringers.

This Policy applies to content posted, uploaded, or otherwise made available through the Oath website and apps (the “Service”). If Oath does not host user-generated content in your version of the Service, this Policy may be unnecessary.

1) What this Policy covers

Copyright law may protect text, images, code, videos, audio, and other original works. If you believe content on the Service infringes your copyright, you may submit a DMCA takedown notice as described below.

2) How to submit a DMCA takedown notice

To file a notice, send a written communication to our Designated Copyright Agent (email is preferred) that includes all of the following (as required by 17 U.S.C. § 512(c)(3)):

  • Your contact information: your full legal name, mailing address, telephone number, and email address.
  • Identification of the copyrighted work you believe has been infringed (or a representative list).
  • Identification of the infringing material and information reasonably sufficient to locate it on the Service (e.g., URL, screenshot, contract page, user profile, timestamp, and description).
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
  • Your physical or electronic signature (typing your full legal name is acceptable as an electronic signature).

We may request additional information if your notice is incomplete.

3) What happens after we receive a valid notice

After receiving a valid notice, we may:

  • remove or disable access to the allegedly infringing material, and/or
  • notify the user who posted the material (the “Content Poster”).

We may also take additional steps where appropriate (e.g., account warnings, restrictions).

4) Counter-notification process

If you believe material was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Copyright Agent. Your counter-notice must include (as required by 17 U.S.C. § 512(g)(3)):

  • Identification of the material that was removed/disabled and where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed/disabled due to mistake or misidentification.
  • Your name, mailing address, phone number, and email address.
  • A statement consenting to the jurisdiction of the Federal District Court for the judicial district where your address is located (or, if outside the U.S., to a judicial district where Oath may be found), and that you will accept service of process from the complaining party.
  • Your physical or electronic signature.

If we receive a valid counter-notice, we may forward it to the original complainant. Unless the complainant files an action seeking a court order, we may restore the material within 10–14 business days (or as otherwise permitted by law).

5) Repeat infringer policy

Oath may, in appropriate circumstances and at our discretion, suspend or terminate accounts of users who are determined to be repeat infringers. We also reserve the right to remove content and restrict accounts for other intellectual property violations, including trademark violations, where appropriate.

6) Misrepresentations

Submitting a DMCA notice or counter-notice contains legal assertions. Knowingly making material misrepresentations may result in liability under 17 U.S.C. § 512(f). If you are unsure, you may wish to consult an attorney before submitting.

7) How to report non-copyright issues
